Terms of Service

Service: Moneyline at moneyline.fromthethink.com, operated by FromTheThink ("we", "us", "our").

1) Acceptance

By using Moneyline you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

2) Who may use the service

You must be at least 13 years old to use Moneyline. If you are located in the European Union or United Kingdom, you must be at least 16. By using the service you represent that you meet the applicable age requirement.

3) The service

Moneyline is a free browser game. We may change, suspend, or discontinue any part of the service at any time without notice or liability.

4) Acceptable use

You agree not to:

  • attempt to access, probe, or tamper with back-end systems or APIs not intended for public use;
  • use automated tools to scrape, spam, or place excessive load on our servers;
  • reverse-engineer, decompile, or misappropriate game content or source code;
  • use any service in any way that violates applicable law.

5) Intellectual property

All content in Moneyline — including the game data, questions, design, source code, logos, and trademarks — is owned by FromTheThink or its licensors. Nothing in these Terms grants you ownership of that content.

6) Third-party services

Moneyline depends on third-party hosting and delivery providers. Your use of the service may also be affected by the terms and policies of those providers.

7) Disclaimers

ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

8) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), FROMTHETHINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN ALL CASES, FROMTHETHINK'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU HAVE PAID TO FROMTHETHINK IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) USD $100.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. If you are a consumer in the EU or UK, mandatory consumer protection rights under your local law are not affected by these Terms.

9) Indemnification

You agree to defend, indemnify, and hold harmless FromTheThink and its operators, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of or access to the service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit through the service.

10) Dispute resolution

Informal resolution. Before filing any legal claim, you agree to first contact us at info@fromthethink.com with a written description of the dispute and your desired resolution. We will attempt to resolve the dispute informally within 30 days of receiving your notice. If the dispute is not resolved within that period, either party may pursue available legal remedies.

Class action waiver. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FROMTHETHINK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING.

Time limit on claims. Any claim arising from or related to these Terms or the service must be filed within one (1) year after the claim arose, or it is permanently barred, to the fullest extent permitted by applicable law.

These dispute resolution provisions do not apply where prohibited by applicable law, including for users in the European Union or United Kingdom where mandatory local law governs.

11) Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. For users located in the European Union or United Kingdom, mandatory protections under your local law also apply and are not displaced by this clause.

12) Changes to these Terms

We may update these Terms at any time. The "Effective date" at the top reflects the most recent version. Continued use of the service after a change constitutes acceptance of the updated Terms.
